Sifututor Tutor Service Agreement

This Tutor Service Agreement (“Agreement”) outlines the terms and conditions governing the relationship between you (“Tutor”) and Sifu Edu & Learning Sdn Bhd (“Sifututor”), an educational technology platform connecting Tutors with Customers seeking academic tutoring services online or in person. By registering and providing services through the Sifututor platform, you agree to the terms outlined below.
1. Definitions
“Platform” refers to the Sifututor website, app, and supporting systems used to facilitate class matching, scheduling, and payment.
“Tutor” refers to the individual offering tutoring services via the Platform.
“Customer” refers to the individual who books a class on the Platform for themselves or a Student under their care.
“Student” refers to the individual receiving the tutoring service.
“Session” means a scheduled tutoring class between a Tutor and a Student arranged through the Platform.
2. Role and Relationship
2.1 Independent Contractor: You acknowledge that you are an independent contractor and not an employee, agent, or partner of Sifututor. You are solely responsible for how you deliver the services, as long as they meet Sifututor’s educational standards.
2.2 No Employment Benefits: This Agreement does not entitle you to employee benefits such as EPF, SOCSO, insurance, or paid leave.
2.3 Non-Exclusivity: You may offer your services on other platforms or independently, provided you do not solicit or engage Sifututor Customers outside the Platform.
3. Tutor Registration and Eligibility
3.1 You must:
a. Be at least 18 years of age;
b. Provide accurate identity, qualification, and supporting documents;
c. Pass Sifututor’s vetting and onboarding processes;
d. Maintain updated contact information, banking details, and subject availability.
3.2 Sifututor reserves the right to approve or deny registration, and to suspend or deactivate your profile for non-compliance.
4. Tutor Responsibilities
4.1 Service Quality
You must:
a. Conduct all Sessions professionally and punctually;
b. Tailor lessons to the Student’s needs and learning objectives;
c. Ensure a safe, respectful, and distraction-free learning environment.
4.2 Conduct
Any form of discrimination, harassment, abusive behavior, or misconduct will result in immediate termination.
4.3 Schedule Commitments
You agree to honor the total number of sessions and class hours as stated in the tutor request assigned to you. Any changes to frequency, number of sessions, or schedule must be communicated promptly to the Customer and Sifututor.
4.4 Attendance Reporting
4.4.1 You must schedule all sessions and record attendance accurately and submit it no later than 24 hours after the class date. Failure to comply will result in forfeiture of payment for that Session, subject to case-by-case review by Sifututor. Timely reporting ensures platform reliability and prompt payout processing.
4.4.2 If you encounter any app-related issues (e.g., classes not appearing, attendance not saving), you must immediately report the problem to the Tutor Experience team via WhatsApp or email. Unreported issues will not be accepted as grounds for exemption.
4.4.3 Falsified attendance reports or repeated non-compliance with reporting procedures may result in disciplinary action, including suspension or permanent removal from the platform.
4.5 Reports
You are required to submit a Student Evaluation Report after the first class, and a Progress Report every 12 verified sessions via Sifututor app.
5. Class Management and Cancellations
5.1 Confirmed Schedule: Once a customer agrees to the Session details (date, time, and duration) at least 24 hours prior, the agreed terms are final. Any changes within 24 hours require mutual agreement.
5.2 Tutor Cancellations: If you must cancel a Session, you must give at least 24 hours’ notice for both online and home classes.
5.3 Late Cancellations: If cancelled late, Sifututor may issue a replacement or refund to the Customer and adjust your payout accordingly.
5.4 Emergencies: In the event of emergencies (e.g., illness or accidents), notify the Tutor Experience team and the Customer as soon as possible. Supporting documents may be requested.
5.5 Replacement Classes: Any missed or canceled sessions must be replaced within the same billing cycle and can only be carried over to the next cycle upon mutual agreement with the customer.
5.6 Additional Sessions: If Customers request additional sessions or hours beyond the agreed package, Tutors must obtain prior consent from the Customer and update the schedule through the Platform.
5.7 Resignation: Tutors must give one month’s written notice to both the student and Sifututor. The applicable Commitment Fee (amount subject to current platform policy) will be refunded upon successful completion of the notice period and proper offboarding.
6. Payments
6.1 Tutor Rates
Your hourly rate is determined by subject level and is visible on the Platform.
6.2 Payout Schedule
6.2.1 Tutor payments are processed twice monthly:
a. If a Customer verifies classes by the last day of the same month, your payout will be issued between the 1st–15th of the following month.
b. If verification occurs between the 1st–15th of the next month, payout will be issued between the 16th–end of that same month.
c. If verification occurs after the 15th, payout will be processed in the next available cycle.
6.2.2 If you do not receive payment for verified Sessions within 15 days of the expected payout window, you may escalate the issue to the Tutor Experience team.
6.2.3 Payout slips are issued at the end of each month.
6.3 Payment Conditions
6.3.1 Payouts are strictly subject to:
a. Only Sessions verified by Customers on the Platform
b. No direct payments from Customers
c. Compliance with reporting timelines and platform policies
6.3.2 Sifututor reserves the exclusive right to authenticate attendance and verification data.
6.4 Bonuses and Incentives
Tutors may be eligible for performance-based bonuses or referral incentives.
6.5 Direct Payments Prohibited
You may not accept or request direct payments from Customers. Doing so may result in permanent removal.
7. Performance and Feedback
7.1 Sifututor collects feedback from Customers.
7.2 Repeated complaints or violations may lead to suspension or termination.
7.3 Tutors may request support or feedback to improve performance.
8. Privacy and Confidentiality
8.1 You agree to keep Customer and Student information confidential.
8.2 Sifututor processes Tutor data in compliance with Malaysia’s PDPA.

9. Intellectual Property
9.1 Lesson content you create remains your property unless otherwise agreed.
9.2 You may not reproduce or share materials from other Tutors or Sifututor without permission.
10. Termination and Suspension
10.1 You may deactivate your account by submitting a one-month notice (aligns with Section 5.7).
10.2 Sifututor may suspend or terminate your account for:
a. Repeated no-shows or late cancellations;
b. Misconduct or inappropriate behavior;
c. Customer complaints;
d. Solicitation of Customers outside the Platform;
e. Breach of any terms in this Agreement.
11. Disputes and Resolution
11.1 Attempt resolution respectfully with Customer.
11.2 If unresolved, notify Sifututor — investigation and mediation will follow.
11.3 Governed by Malaysian law.
12. Amendments
Sifututor reserves the right to modify these Terms at any time. Continued use of the Platform after updates constitutes acceptance.
